Whether encryption is necessary depends on Rapidshare's future policy and the legal landscape.
The law does not now require a file host to inspect user uploaded content, but just in case that the law was to change, it is better with encryption.
Rapidshare has done much to placate copyright holders, but manual inspection of files only being stored as opposed to being shared is probably a red line they wont cross without being forced by law.
You should also set the sharing permission to not shared, so that only yourself can download the files.
This also makes it harder to argue even technically that you are using your account for file sharing by making files available for others.

FYI you need a premium account for longterm RS storage, files on a free account are deleted after 30 days inactivity
