I'm going to assume you recently upgraded to 3.3.1?

The skin is outdated and needs to be upgraded.
Try using the merge skin tool, but be sure to have a backup copy.

not really the problem was in 3.2.3 but i used some other skin

now after updating to 3.3.1 this skin(velvet) is also updated to 3.3.1 but not my current skin, so if i could get this solved i can use this
the only problem in this skin is image re-sizing (was there in 3.2 as well)
