Avoiding Prosecution
A story, Prevention Methods, How to.

Introduction

Are you worried that your online lifestyle may someday get you into trouble? Or do you simply have no fear at all? In a lot of cases we find ourselves addicted to the lifestyle that we have created. The fans, the money, the points, the pluses of being a pirate. Sometimes, we get so caught up in that we become blinded and the success we share ultimately can and will destroy us.

In this text you will read about what happened to me, and what/how I fought back. The steps that I take now and the steps that I failed to take in then. Important information regarding virtually all online users in this scene, and ways to protect yourself and your computer from the impossible.

1.) Excessive Downloading.
2.) Excessive Uploading.
3.) Run a large profit based community.
4.) Run a large community where you publicly share content.

6.) Cracking/Hacking.

If you think that you aren't being watched, you could be right. However, wouldn't you rather take every necessary steps to ensure in the event that you are being monitored and placed under scrutiny, you will come out on top?

Prisons are filled with brilliant people who thought "they would never get caught".

My Story

Over the years I have found myself into several jams offline. But when it came to online life I thought I was untouchable. I had everything figured out, I knew all the right people in all the right fields. There wasn't anything that I coudln't do, and if I couldn't do it I knew someone who could. It was fun, fast, easy, and a crazy lifestyle. It was like a whole new world which I dominated in every aspect. It would cross my mind from time to time that my online life may one day catch up to me, but I always thought I covered my ass. Proxies, falsified accounts, random ISP's, associates over seas and so on.

I mean, I had been doing this since 1998, no problems, so much knowledge, what could happen to me? Nothing, or so I thought. I was wrong, very wrong....

On October 17th, 2007. I woke up and went about my day as usual. Took a shower, checked my online accounts, turned on my mail servers and went to work at the Machine Shop for my 12 hour night shift. Then I would come home and work on UW, moderate Katz Forums, spread the newest CC's for the day. These credit cards could be found on the earlier USAWarez's, inside V.I.P's and being sold on WauShare and many other underground forums.

Then I received the phone call. Which went something like this.

"They're coming, they are on the way, get everything & get out"

I recognized the voice almost instantly. I took my sacred laptop and desktop computer to a friends house and parked them there. Then I came back and stayed in the back of house. See at my house there is two houses in one. The front of the house, and then the addition in the back which is only a few years old. You can't tell anything is there unless you take the time to walk around the property because it is directly off the back of the garage.
Then I received the second phone call. Which went something like this.

"I talked to ****, they took him down man, just thought I'd let you know"

The individual responsible for this phone call was and is an actual FBI informant. This call was received the very moment that the FBI walked into the house next door. This person had never called me prior to this, and I knew instantly who it was. This persons name will remain private, but as the story continues you will see the games that I played with them. So I took the battery out of my phone, and laid in silence, waiting for them to enter into my home. I could hear the doors next door opening and closing as the Feds were searching through my house. Looking for computers, evidence and me. After a while passed I knew they weren't going to be coming into my part of the house and it remained silent for about an hour.
Then the door opened. It was my dad with a hand-written letter explaining to me what had happened, and the name of a Greg Ryman out of the Washington D.C field office with his cellphone number telling me to call. The letter my father handed me also went on to explain how the government flew in from Washington D.C (to Cleveland, Ohio) for unknown reasons and during the time they were there forced them to sit on their couch while they ran long block oblong objects over the tv's, phones and computers (I still have no idea what those devices were). As the agents (4) crawled through the home they discovered a personal computer used by my brother and a desktop computer used by the entire household (which none have been returned or ever will be seen again).
I then decided to call the agent and give him the time of day, so I placed the battery back into my phone and called the number written down on the piece of paper that my dad handed me. We spoke for a few moments and we set up a place to meet.. The local McDonalds. Hell I thought I'd get something to eat before going to jail lol. When I got there I was presented with 2 field agents, Joe Oliver of Cleveland and Greg Ryman of the Washington D.C field office.
Mr. Ryman proceeded to ask me all sorts of questions, and basically asked me to tell him my story. Which I told him he was there to arrest me for USAWarez. He peered at me awkwardly and I almost lost my calm but then he said to continue, which is what I very well did. Told him how I ran USAWarez and operated it for years and the whole shabang. He then wen't into detail asking about Katz & the Katz Network, my private screennames and emails, my domain information, the people whom uploaded on my website and the most active members. These questions were bizarre. Me personally, not even being worried about these questions shrugged them off and gave the most common answer You have my server, you have my computers, you have all of the information in your posession anything that I have to say will be done with my attorney present", they didn't like that very much, so it cut our conversation short.
I was then taken to the local precinct and processed for some other outstanding warrants not related to the crime that I had allegedly committed at that time (which I was not sure of what exactly I was being charged with). On the way, they informed me to not tell anyone, not to tell the police and especially not to tell anyone online what had happened. I agreed and as soon as they left I told the police what had happened lol. My bond was re-instated the next morning on my case and I was released from jail.
From there I continued to receive and place calls to and from the FBI informant who was continuing to monitor my state after the raid and gather information in regards to his precious case. At which time I continued to play into the game as I gave this guy the complete runaround.
See I'm someone who has a remarkable memory recognition feature embedded within my mind, I can remember everything said in a conversation down to the detail and I never forget what time things take place or if I have a feeling about something. This guy from day 1 had me wondering what is up. Why?

Reasons:
1.) Logged onto my forum using multiple user names.
2.) Was 30+ years old and was online more than me.
3.) Claimed to have gotten a second job to donate to the empire.
4.) Claimed to have had a team (which consisted of he himself and him).
5.) Claimed to this and that for an occupation when changing the script the next day and all of a sudden becoming a plumber, or a IT server guy, or an online child porn investigator.

So in the back of my mind I knew all along this guy was an informant, or an agent or just not on the up and up. So I bated him, I let him send me money, I let him upload to my servers, I let him continue to work his way up on my team. All the while gaining evidence to provide proof to the government that my site was funded by the government, that I had knowledge of the informants attempt at gaining access into my community and I allowed him to do so because I did not want to receive an Obstruction of Official Business. I recorded every data transfer made by the informant and kept the logs on my computer. All of the paypal transfers, phone conversations and MSN chats were logged as well.

I then waited years for the case to get going. At which time I gave up on the whole UW thing and passed the torch on in many places as there is now currently three up and running, which puts a smile on my face these days. Speaking with this informant during the time here and there, throwing him in one direction and throwing him in that direction, toying with him as my daily life continued and I had the plot to screw him. Finally the day comes when I have something to do. The 500 billions documents are sent to me accusing me of uploading pirated material. They accuse me of uploading movies dating back to when I had 56k LOL. I kindly had my lawyer send them a notice and in response they dropped one count and kept the other (Trafficking Counterfeit Labels). Which they also have zero proof that I uploaded anything considering that this movie also was not uploaded by me and was not downloadable due to specific various reasons. So I signed all of the pages except for page #6 which specifically states my acknowledgement to doing all of these things. lol. They didn't notice... Or my Lawyer filled it in without my knowledge.

So now I was being taken to court without agreeing to the plea agreement, my collected evidence against the government on the tiny 1gb flash drive snuggled warmly in my right pocket, and a big fat smile on my face.

God was the case thrown out so fast, the district prosecuting attorney for the united states of america (Tyle Newbie) had to regain his composure, collect himself in the judges chambers and collectively come up with a reason or excuse as to why the government had misfumbled the entire case wasting thousands of american tax paying dollars and thus the case was closed.

Thus is where I am today. Sitting somewhere in the puter space, saying this and saying then, making people wonder what and who, and the reason behind it is simple. I don't want to get into trouble, I am not better than the system I can only match the systems move. I could very well have my day someday with what I do, but I take every step possible to ensure that that doesn't happen.

Playing the Game

Our online lives are like a game. We all make moves, take risks, invest, hope and strive to be the best in what it is that we do. If we are willing to do all of these things to become successful, then why is it that so many times we fall to the fate of raids and government persecution? The answer is quite simple, we continuously overlook the possibility and think "It won't happen to me". The problem is, once you start thinking like that, you are almost guaranteed to wind up in some legal bind.

If you are someone who is envolved in risky situations that potentially could lead up to an arrest in the smallest matter. Or if you are operating a high profile warez community or ponzi scheme, then you should adhere to the simple rules of the game.

Never get too comfortable with your surrounding. Individuals that are by your side are generally a username with some text. They are as loyal as they can be until the moment of disaster strikes and they will turn on you so fast. The lesser amount of people that have your private information the lesser chance you have of destroying yourself.

If you think you are safe visiting random forums across the web in this scene using your username and surfing without a proxy, you are mistaken. Once mishap one tiny wrong step could leave your computer and your entire online operation vulnerable. Once the authorities grasp your i.p address you can and will be placed under review for all of your frequented website addresses, downloads and uploads.

MSN, AOL, YAHOO accounts can be subpoenad which means they can access all of your contacts, emails and isp information. The way around this is to use MULTIPLE accounts. Having a public MSN is like giving your worst enemy a gun and pulling the trigger for him. You basically are offering yourself up for grabs. You don't think this happens? Then you are a fool.

The government will use any way possible to obtain your private information. They will work their way up in your community, create various communities throughout the warez world of semi-popularity hoping that you will sign up and reveal yourself to them. They will be your greatest friends, do the most for you, and these people are so hard not to trust... It's their fucking job lol. So what you can do is be nice to everyone and treat everyone the same, try not to let anyone stand out and if they keep showing up on your screen then assume the worst. It's a shitty way to live but it's the way.

The lesser people to associate with, the lesser you put yourself out there, the better chance you have of being safe. Sticking to your own home front, and staying with yourself is the way to go. Understandable there is some rock-solid people out there, and I myself associate with some, but those who I talk to don't even know they talk to me, and those who think they talk to me have no idea.

Keeping them on edge and guessing and the possibility of Reasonable Doubt is always the best answer when it comes to court ladies .

If you are running a forum allowing vip subscriptions and donations. Don't allow those transfers to come into your direct account. Use someone elses, make a false account with false information, its not hard to do. Don't login to that account too often, have someone oversea's create that account with a pre-destined email you have created. You need to be smart.

Government monitors payments, sees the money, watches, waits and laughs at you for thinking they werent building their case the whole time. Then they pounce on you with so much collected data your screwed.
